A Federal Tool to Hold Districts Accountable

The U.S. Department of Education's Office for Civil Rights (OCR) enforces federal laws that prohibit discrimination in schools, including Section 504 of the Rehabilitation Act, Title II of the ADA, and Title VI. When a school district violates these laws, families can file a complaint with OCR at no cost. OCR has the authority to investigate, mandate corrective action, and even withhold federal funding from non-compliant districts.

Situations Where an OCR Complaint May Apply

  • District refuses to evaluate your child for a disability
  • A 504 plan is in place but is not being implemented
  • Your child is being disciplined differently because of their disability
  • The district failed to provide services after a traumatic brain injury or medical event
  • Your child faces a hostile environment based on disability
  • The district refuses to provide required accommodations or modifications
  • Retaliation against parents who advocate for their child's rights

How OCR Investigations Work

OCR complaints must be filed within 180 days of the discriminatory act. OCR will notify the district and conduct an investigation, which may include document review and interviews. If OCR finds a violation, the district must enter a resolution agreement outlining corrective actions. Attorney Sparks helps families document violations, draft compelling complaints, and follow through to ensure the district fully complies.
